General Terms of Sale :

Article 1 : Customer Restrictions :

The internet site https://dildoshop.fr  propose  products intended only for adults. This site can contain images with sexual character which can offend a not warned public.

You are at least 18 years old or the age of the legal majority in your country of residence.

Where Goods may only be purchased by persons of a certain age the Buyer will be asked when placing an order to declare that they are of the appropriate legal age to purchase the Goods.

If the Seller discovers that the Buyer is not legally entitled to order certain Goods, the Seller shall be entitled to cancel the order immediately, without notice.

Article 2 : Orders :

You can place your orders only by Internet on http: // dildoshop.fr.

We will process your order much faster.

We will process your order within the limits of our available stocks or subject to available stocks at our suppliers. When placing your order we inform you about the availability of the products which you wish to buy. Nevertheless, if despite exercising every care some products are temporarily not available after you placed order (stocks have run out, etc), we will inform you by e-mail and we will suggest you to cancel or to modify your order. If products are definitively unavailable (exhaustion of the stock, end of production, etc.) after you placed order, we will cancel automatically your order and we will inform you by e-mail and we will pay you off the amount due.

Article 3 : Prices :

The prices of our products are quoted in Euros, all taxes included. They do not include delivery charges, billed at cost, and indicated before the validation of the order.

The prices include the VAT applicable on the date of order. Any rate change will be reflected on the prices of products.

All orders, whatever their origin, are payable in Euros.

All prices are subject to change without notice and we reserve the right to modify prices at any time. Nevertheless, products will be charged to you on the basis of the current price lists at the time of the recording of the order, subject to availability.

Any orders delivered outside mainland France might be subject to any local taxes, duties, and dock dues and customs fees upon delivery. Their acquittal is then charged to the customer and within its sole responsibility.

Article 4 : Secure Payment :

PayPal provides a secure method of payment and reliable protection of data. It is a recognized secure payment system with SSL (Secure Socket Layer):  Information transmitted by electronic means shall be encrypted and cannot be read during the transport through the network.

Furthermore with PayPal we have at no time access to your banking coordinates.

Article 5 : Discrete Delivery :

Shipping of your parcel :

Your order will be shipped upon receipt of your payment.

All our parcels are packed in a neutral way and only the name: UP E-Commerce will discreetly be mentioned. Only you can retrieved the parcel.

Our parcels have a tracking number, which we will send you by e-mail. This allows you to follow the shipping in real-time.

Shipping:

For shipments in France:

-         POST – Colissimo: shipping within 48 hours anywhere in the France Metropolitan. 

For shipments to Europe:

-         International POST - Colissimo: shipping between 3 and 5 days for Europe, and between 5 and 10 days for the rest of the world. 

Forwarding charges

Shipping costs include packaging, handling and postage. They may contain a fixed part and variable part based on the price and/or the weight of your order. We recommend that you group together your purchases into a single order. We can not group together two separate orders and you will have to pay postage for each of them. Your package is shipped at your own risk. However, special care is provided to the packages containing fragile items.

Also, the packages are oversized and protected.

We cannot be held responsible for delays due to strikes of postal services or other unforeseen provided by the legislation on the transport of articles and goods.

Article 6 : Right of withdrawal :

The buyer has a cooling-off period of 7 days from the validation of his order and he can so exercise his right of withdrawal. The customer is responsible for the shipping costs in returning the merchandise to us.

If product purchased has not met your expectations, it must be returned in its original purchase condition, with the original packaging. All returned items must be in their intact condition, not have been used and include all accessories, packaging, instruction manuals, etc. Dildoshop.fr can refuse to accept or refund returned articles when the packaging has been opened or when the products have been used or damaged by the buyer. Furthermore, products with any sign of being used will not be refundable for hygiene reasons. Nevertheless, we pledge to do everything we can to respond to all your requests.

Products excluded from Right of withdrawal: Underwear, clothing, lubricants, stimulants and aphrodisiacs are neither exchangeable nor refundable.

Article 7 : Responsibility :

Products proposed on http: // to dildoshop.fr site are products for adults only. We decline any responsibility regarding their use.

Photos, texts, graphics, informations and characteristics reproduced and illustrating the presented products are not contractual. Consequently, Dildoshop.fr will not be held liable in case of error or omissions in one of these photos, texts or graphics, informations or characteristics of products or in case of modification of the characteristics of products by the suppliers.

Article 8 : Personal data protection :

We undertake to protect the data that is personal to you. All personal data that we have collected about you is handled with the strictest confidentiality, in accordance with the provisions of our personal data protection policy.

When you carry out your purchases, we ask you essential information only to ensure the quality of our services and to properly process and fulfill your order. We do not sell, do not market nor do not rent these informations with thirds.

In accordance with “the Data Protection Act” (Informatique et Libertés) of the 6th January 1978, you have the right to access, modify, rectify and delete your personal data by contacting the website's editor.

Article 9 : Applicable Law

Clauses in these general terms of sale as well as all the operations of purchase and sale which are aimed at it, will be subjected to the French law. The Courts will be the ones within the competence of Chamigny Sur Marne, Courts of the head office of UP E-Commerce where is established the contract between the parties.

These general terms of sale as well as prices are expressly approved and accepted by the buyer, who declares and admits having a perfect knowledge, and renounce, therefore, waivers prevailing of any third party document, in particular said party's own general purchasing conditions, the confirmation of the order resulting in the acceptance of these general terms of sale.

In accordance with Article 1369-5 of the French Civil code concerning the conclusion of a contract in electronic form, you can visualize the detail of your order and its total price, correct possible mistakes, before confirming this one to express your acceptance.

The present general terms of sale may be modified at any time without prior notice.
